Welcome to Snake River Meadow! These terms and conditions constitute an agreement with you (your “Facilities Agreement”) for your use of some or all of the facilities at Snake River Meadow. These terms and conditions are subject to change from time to time. By booking a stay at Snake River Meadow, you agree to be bound by this Facilities Agreement.
DEFINITIONS
“Confirmation Email" means an email sent to you confirming your rental of Facilities, including price and dates.
"Deposit” means the deposit amount, if any, set forth in your confirmation email.
“Event” means the event, if any, described in your Confirmation Email.
“Facilities” as used in this Facilities Agreement means the particular lodging unit(s) or venue(s) described in your Confirmation Email.
“Parties” means Snake River Meadow, as owner and landlord of the Facilities, and Renter as tenant and renter of the Facilities during the Rental Term.
“Owner” or “Snake River Meadow” means Heise Meadows, LLC, an Idaho limited liability company with an address at 71 N 5050 E Ririe ID 83442
“Renter” means the user of the Facilities indicated above. Renter is at all times a “guest” and is not a tenant under Idaho law.
“Rental Fee” means the fee amount set forth in the Confirmation Email.
“Rental Term” means for each of the Facilities from 4:00PM on the date of your arrival, as set out in your Confirmation Email, and ending at 11:00AM on the departure date identified in your Confirmation Email. If only one date is listed then it means from 12:00PM on such date through the end of that date.
“Rules” means those rules of Snake River Meadow listed on Attachment A hereto. The Rules may be supplemented at any time by editing the Rules on this web page.
TERMS AND CONDITIONS
- Rental of the Facilities: Assuming the Deposit has been paid, Snake River Meadow hereby agrees to rent to Renter the Facilities for and during the Rental Term. For the avoidance of doubt, Renter is renting specific facilities and not the entirety of the property or its grounds. Other invitees and guests of Owner may access the grounds from time to time while respecting the privacy of the Renter in the facilities.
- Purposes: Snake River Meadow Rules: The Facilities are to be used for purposes of the Event as set forth in the Confirmation Email and for such other purposes as are contemplated by or set forth elsewhere within this Facilities Agreement. The Facilities may not be used for any purpose other than those mentioned herein without the prior written consent of Snake River Meadow.
- Property Rules: The Rules of Snake River Meadow shall be followed at all times by Renter and Renter’s guests, invitees, agents, contractors and caterers. If Renter or its guests fail to follow the Rules, Owner may impose a fine of up to $2,000 in the Owner’s absolute discretion. If Renter deliberately refuses to follow any Rules after being reminded, the Rental Term may be terminated at that moment by Owner, and Renter and guests will leave the Property immediately.
- Deposit/Rental Fee: Renter has paid or will pay the Deposit on or about the date hereof. Renter has no obligations hereunder unless the Deposit has been paid. The Deposit is non-refundable under all circumstances. Renter agrees to pay Snake River Meadow the Rental Fee (less the Deposit) no later than two weeks prior to the start of the Rental Term. All funds shall be paid by cash, Venmo, credit card or check.
- What’s Included and Not Included: The Rental Fee only includes the rental of the Facilities and use of fixtures, appliances, tables, chairs and benches located at the Facilities on an as/is basis. Items and services such as food catering, tractor-drawn wagons and carriages, valet parking, etc., are not included and may be available from Snake River Meadow at an additional fee.
- Pre-Event Walk-Throughs: If you are renting a venue (in addition to lodging), included in your package is one complementary walk-through (in addition to any visit you made before signing this agreement). The purpose is for you and/or your vendors to plan for your event. This can be scheduled with us for a mutually convenient time where one of our team members will meet you at the venue. Each additional walk-through, whether for you or your vendor(s), will be at the cost of $50.
- Cancellation: If Renter cancels in writing within 30 days of the Rental Term, it will not owe the Rental Fee that has not yet been paid (though the Deposit will be forfeited). If it cancels after such time, Renter remains liable for the entire Rental Fee.
- Condition of Facilities: Renter shall leave the Facilities in the same or similar condition as when Renter entered, except that it may leave trash in designated receptacles. Any trash of Renter or Renter’s guests or its caterers or invitees that does not fit in the designated receptacles must be taken away by Renter. Renter shall also be responsible for any damage caused to Facilities beyond ordinary wear and tear by Renter, Renter’s guests or its caterers or invitees.
- Indemnity: Renter hereby indemnifies and holds harmless Snake River Meadow, its employees, agents, heirs, successors and assigns from any and all damages, actions, suits, claims, or other costs (including reasonable attorney fees) arising out of or in connection with any damage to the Facilities or any injury cause to any person (including death) caused by Renter’s use of the Facilities, including any acts or omissions on the part of Renter, independent contractors, guests, invitees, or other agents. Renter shall immediately notify Snake River Meadow of any damage or injury of which they have knowledge in, to, or near the Facilities, regardless of the cause of such damage or injury.
- Credit Card Authorization: Renter hereby agrees that Snake River Meadow may place a refundable charge on Renter’s credit card in an amount of up to $2,000 for any damages or costs (including for trash removal) or indemnity obligations for which Renter is responsible pursuant to the terms herein. The amount will be refunded within one week after the Event after inspection of the Property by Owner, less any amounts applied toward damages, costs, indemnity obligations or fines. This amount is not liquidated damages nor shall be interpreted as any limitation on Renter’s liability hereunder for damages, losses and harm caused by it or its guests, caterers, invitees or others.
- Pets: Pets are welcome everywhere except inside the new lodge. If any pets stay in the Cottage, an extra $50 cleaning fee will be charged. If they stay in the Ranch House, a cleaning fee of $150 will be charged. Renter is responsible for their pets’ care and any damage or harm they do.
- Compliance with Laws: Renter shall obtain and maintain any necessary permits, licenses, or other forms of permission necessary to use the Facilities according to the permitted uses set forth above in a lawful manner. Renter shall not use the Facilities in any manner that would violate any local, state or federal laws or regulations. Renter hereby indemnifies Snake River Meadow, its employees, agents, heirs, successors and assigns, for any damages, penalties, fines, suits, actions, or other costs (including reasonable attorney fees) arising out of or in connection with Renter’s violation of any local, state, or federal laws, rules, regulations or ordinances related to Renter’s use of the Facilities.
- Revocation: Snake River Meadow shall have the right to revoke this Facilities Agreement and the rental hereunder at any time prior to the Rental Term, provided it gives Renter prior written notice of revocation. In the event that Snake River Meadow revokes this Facilities Agreement and the rental hereunder prior to the Rental Term for reasons other than nonpayment of fees or breach of this Facilities Agreement by Renter, Snake River Meadow shall refund to Renter the full amount paid by Renter in connection with this Facilities Agreement, including the entire Deposit.
- Alcohol: Renter may arrange for the distribution of alcoholic beverages at the Event so long as (i) Renter has notified Snake River Meadow that alcohol will be served at the Event, (ii) Renter ensures that the attached Alcohol Policy of Snake River Meadow is adhered to and (iii) alcohol is served in accordance with applicable federal, state, and local laws, ordinances, rules and regulations. Renter shall indemnify Snake River Meadow for any expenses, fines, of fees Snake River Meadow incurs for breach of this provision.
- Safety: Renter agrees that at all times activities will be conducted with full regard for public safety, and will observe and abide by all applicable regulations and request by duly authorized agencies responsible for public safety, including traffic control.
- Access by Owner: Representative of Snake River Meadow may enter the Facilities and the surrounding premises at any time during the Rental Term for any purpose. Such representatives will have the authority to remove any person from the Facilities if in the judgment of such representative(s) removal is necessary to protect the person or other persons on the Facilities, to protect property or for violation of any of the Rules.
- Limitation on Liability: Notwithstanding anything to the contrary in this Facilities Agreement, Snake River Meadow shall not be liable for any damages arising from actions or omissions of Renter, its agents, guests, caterers, and invitees to the extent that such damages are not covered under and paid for by applicable insurance policies.
- Assignment: Except as otherwise expressly provided herein, this Facilities Agreement shall apply to, be binding in all respects upon, and inure to the benefit of the successors and permitted assigns of the parties. Renter shall not assign this Facilities Agreement, nor suffer any use of the Facilities other than herein specified, nor shall Renter sublease the Facilities in whole or in part without the written consent of Snake River Meadow.
- Entire Agreement: This Facilities Agreement constitutes the entire agreement between the parties and shall be binding upon the parties hereto, their heirs, legal representatives, successors, and assigns and no alterations, variations, or additions in or to the terms of this Facilities Agreement shall be valid unless such alterations, variations or additions are in writing and signed by both parties or their heirs, successors or assigns.
- Governing Law: Waiver of Jury Trial: THIS VENUE AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF IDAHO WITHOUT REGARD TO CONFLICT OF LAWS PRINCIPLES. EACH OF THE THE UNDERSIGNED DOES HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVE THE RIGHT TO TRIAL BY JURY IN ANY ACTION OR PROCEEDING BASED ON OR WITH RESPECT TO THIS VENUE AGREEMENT OR ANY OF THE TRANSACTIONS CONTEMPLATED HEREBY OR RELATING OR INCIDENTAL HERETO.
- Attorney’s Fees: In the event that any dispute among the parties to this Facilities Agreement should result in litigation, the prevailing party in such dispute shall be entitled to recover from the losing party all fees, costs and expenses of enforcing any right of such prevailing party under or with respect to this Facilities Agreement, including without limitation, such reasonable fees and expenses of attorneys and accountants, which shall include, without limitation, all fees, costs and expenses of appeals.
- Severability: If any provision of this Facilities Agreement is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of this Facilities Agreement shall remain in full force and effect. Any provision of this Facilities Agreement held invalid or unenforceable only in part of degree shall remain in full force and effect to the extent not held invalid or unenforceable.
- Notices: Notices under this Agreement will be considered valid if given in writing to any party or any representative of that party previously so designated. Writing includes electronic communications, such as emails or text messages.
RULES FOR SNAKE RIVER MEADOW EVENTS
(Remember, you are responsible for making sure your guests follow these rules)
- No driving of motorized vehicles on the grass or meadows. Vehicles are to be confined at all times to gravel roads and parking areas.
- To comply with local sound requirements, loud dance music may be played ONLY inside the venue with the doors closed. Background/mood music may be played outside at a reasonable level. All music must be turned off by 12am. Because the venue’s speaker set-up is carefully placed to be directed away from neighbors, DJs must plug into the speaker system at the venue (which is a modern one) and cannot bring other speakers and place them around the property.
- No swimming or wading in the river (also known as the dry bed). No swimming in the pond without adult supervision.
- No fires outside of the designated fire pits.
- No littering or depositing of trash outside of designated trash receptacles.
- No firearms, weapons or illegal drugs on the premises.
- No fireworks. Sparklers may be used only on gravel and cement areas.
- No nails, screws or staples in the walls inside or outside of the venue or on the fences or posts. However, existing hooks may be used. No hanging decorations from the lighting fixtures. Please respect the property.
- The kitchen is NOT a commercial kitchen, and does not have adequate venting or fire suppression required for cooking for large groups. It should ONLY be used as a warming station and for light food preparation. Dishes and cutlery are available for use but need to be cleaned and put away after use.
- If you use tables, chairs, benches or decor (including backdrops) please put them away where you found them after your wedding.
- Your own grills are allowed but must be kept on gravel/concrete.
- No stakes in the ground longer than 8 inches.
- No digging holes.
- No confetti or fake flowers on the ground - all flowers/confetti used in weddings must be organic or thoroughly cleaned up.
